The Remote Working Regulation


The Remote Working Regulation ("Regulation") was published in the Official Gazette dated
10.03.2021 and numbered 31419. The practice, which already exists in Articles 13 and 14 of
the Labor Law No. 4857, started to be preferred more with the Covid - 19 outbreak. With the
Regulation, the procedures and principles of remote work were determined, along with the
implementation of business rules regarding the jobs where remote working cannot be made,
data protection and sharing.

According to this, the following arrangements have been made:

 

  • The contract for remote work will be in writing,

  • Materials and work tools required for the production of goods and services for the remote worker will be provided by the employer, unless otherwise agreed, the principles of use of these materials and work tools and the maintenance and repair conditions will be clearly and comprehensibly informed to the employee,

  • The conditions for determining and meeting the relevant compulsory expenses will be determined in the employment contract,

  • The time interval and duration of remote work will be determined in the employment contract, overtime work will be done in accordance with the provisions of the legislation upon the written request of the employer, If applicable, the request or approval of the worker will not be sought for the transition to remote work,

  • The employer will take the necessary measures to protect the data of the remote employee's workplace and the work done,

  • If remote work will be applied in the whole or part of the workplace due to compulsive reasons, the employee's request or approval will not be sought for the transition to remote work,

  • The enterprise determined by the employer to protect the data that the remote employee will be obliged to comply with the rules,

  • The employer will be obliged to take the necessary occupational safety measures regarding occupational health and safety measures.


In addition, it has been determined that remote work cannot be performed for jobs involving
studies on dangerous chemicals and radioactive materials.
